If you have an actionable case, you have the right to an award for the financial, physical, and emotional losses you suffered. Types of Cases Our Tobacco Lawsuit Attorneys Represent
Regular or menthol cigarette smoking is a long-standing cause of dangerous health conditions. However, they are not the only nicotine product to blame. In general, tobacco use increases a consumer’s risk and susceptibility to these illnesses. Tobacco companies and manufacturers continue to sell these products to consumers using hazardous materials, false advertising, and violations of consumer protection statutes.
At Shepard O’Donnell Firm, our tobacco lawsuit attorneys will hold them accountable for their negligent actions if you or your family member lives in Massachusetts and suffered from the following types of tobacco-related injuries, including:
- Chronic obstructive pulmonary disease (COPD)
- Emphysema
- Diabetes
- Heart Disease
- Lung Disease
- Lung Cancer
- Throat Cancer
- Birth Defects
- Sexual Dysfunction
- Death
- Other Tobacco-Related Lung Cancers
The increased risk of developing health problems is exponential. Not only is cigarette smoking hazardous to your health, but nicotine is a highly-addictive drug. If you were diagnosed with lung cancer related to cigarette smoking or other illnesses, you deserve compensation for your health care expenses, lost wages, and more when a tobacco or cigarette company violates your rights.
Depending upon the facts and circumstances, you can seek retribution with a tobacco attorney under the following areas of Massachusetts personal injury laws:
- Negligence
- Product Liability
- Failure to Warn
- Wrongful Death
- Fraud
- Deceptive Practices
A tobacco lawyer will help you determine which laws apply to your case and how. Shepard O’Donnell Firm will also conduct a full investigation of your injuries and preserve admissible, related evidence. You do not have to settle for an amount that is less than what you deserve where Massachusetts or federal laws protect your rights.

RESULTS
Asbestos
Shepard O’Donnell litigated several mesothelioma and lung cancer cases for plaintiffs who worked with and around asbestos-containing products during their careers. One case involved a former shipyard worker who was diagnosed with mesothelioma at age 69 and another case involved a 68-year-old man was diagnosed with mesothelioma after having worked in a manufacturing facility that used asbestos products. Both men also had significant asbestos exposure from other sources including several home renovation projects and driveway automotive brake and clutch repairs. Through diligence and hard work, the Shepard O’Donnell team was able to recover millions of dollars for these clients and others in 2016.
RESULTS
Mesothelioma
Shepard O’Donnell successfully litigated the case of a woman who died of mesothelioma. Her mesothelioma was caused by exposure to asbestos from laundering the clothing of her husband, who worked at a facility that coated and cut asbestos paper for use in making gaskets. The case involved two separate suits, due to the late discovery of documents that identified additional suppliers of asbestos paper. The case was vigorously defended and involved extensive motion practice and numerous depositions. After all the factual and legal hurdles were cleared, the case settled for a significant seven-figure sum.
